STROLLERCARE RENTAL AGREEMENT
The customer is renting the products from StrollerCare for the period agreed between the parties. StrollerCare is the owner of the products and the customer must only use them for their own use and may not sublease them to third parties.
Reservations and Payment
Payment must be made by credit card at the time of booking directly on the StrollerCare website.
The customer is aware that the amount paid may be increased in the event of changes to the product (damage, loss) or even changes to the agreed delivery/return locations.
The reservation will be confirmed by email by StrollerCare within a few moments of completing the rental process via the website. The customer should contact us if a confirmation e-mail is not received after making the reservation on the StrollerCare website. Contact can be made by e-mail ([email protected]) or in the chat available on the website where the booking was made (www.strollercare.com).
Delivery
The customer will specify at the time of booking the name and place where the rented product will be delivered and returned.
The exact time and place of delivery and return will be communicated by StrollerCare by e-mail. The customer understands that delivery and return are based on addresses in the vicinity of the Orlando theme parks with a driving distance of up to 30 miles from the Magic Kingdom park, without the use of toll roads.
The customer agrees to contact StrollerCare within 6 hours of the agreed delivery/return date and time by phone, e-mail or chat if they are unable to receive or return the rental product as agreed.
The customer agrees that deliveries and returns at a Disney World owned resort can only be made in person with a StrollerCare representative.
The customer agrees and understands that all requests to change an existing booking must be made at least 24 hours before the delivery time agreed at the time of booking.
If at the time of delivery the customer is not at the agreed place and time (in cases where they need to be present to receive or return the product) or has provided the incorrect delivery location, resulting in a second trip for a new delivery attempt, a fee of US$15 will be applied.
The customer understands that any rental product returned to a location outside of our delivery area may incur a $125 fee.
In the event that the customer has traveled outside of our delivery/return area and is unable to return, it is the customer’s responsibility to ensure that all rented products are returned to StrollerCare on the original return date via cab, ride-sharing services, courier or freight. All charges for such return will be the sole responsibility of the customer.
The customer agrees to maintain good use of the rented product throughout the rental period. Rented products must be kept safe when not in use.
The customer agrees to immediately inform StrollerCare of any defect or malfunction during use of the product. Once notified, StrollerCare will make every effort to resolve the problem in a timely manner.
The customer agrees to use the rented product only for its intended purpose, in the manner for which it was designed. At no time should the weight limits stated on the StrollerCare website be exceeded.
The customer agrees that violations of this agreement may result in termination of the rental. StrollerCare reserves the right to terminate the rental based on evidence of abuse or violation of any and all parts of this agreement.
The customer agrees that any request to exchange a stroller due to a stroller left in the rain, child vomit, diaper leakage or other bodily fluid, will be charged a $15 exchange fee.
Return
- Non-Disney resort or hotel: It is the customer’s responsibility to ensure that all rental products are available for pick-up at the designated location on the date and time specified in the reservation. All items must be returned to the front desk of the resort or hotel listed in the confirmation email. No rental items should be left in guests’ rooms after checkout. Rental items left in rooms will incur a US$25 recovery fee. The client is 100% responsible for the items that will be available at reception for pick up.
- Vacation homes: The customer agrees that when returning to a vacation home the rented product must not be left on balconies or even in front of the residence outside of the return time unless it has been agreed with StrollerCare in advance. In the event that the product is stolen because it was left by the customer until StrollerCare arrived, the customer will be responsible for paying in full for a new product equal to the one rented, based on the prices on the Amazon website.
- Disney-owned resorts: The customer must be available in person at the agreed time and place for return with a StrollerCare representative. In the event of not being present at the agreed time and place, a new time may be arranged for delivery according to StrollerCare’s availability. It will also incur a $15 fee for a new appointment.
If the customer wishes to extend the rental period, they must inform StrollerCare 6 hours before the previously agreed return time. StrollerCare may allow or deny any extension. The customer agrees to be charged US$10 for each additional day the rented product is kept by the customer.
The customer agrees that a fee of US$20 may be applied for pick-up trips of rented items that are not returned within the agreed timeframe as listed on the rental reservation.
The customer may request an exchange of the product for reasons of size or similar. These requests are at StrollerCare’s sole discretion based on product availability. These requests are subject to a fee of US$10 per item + difference in value of the products, if any.
Damage or loss
The customer assumes full responsibility for the care of the rented product while it is in their possession.
The customer is responsible for paying the full replacement value of any product rented under this contract that is not returned to StrollerCare within 48 hours of the end of the contract.
The customer is responsible for paying the replacement cost of any parts or accessories lost, paid for or supplied free of charge.
The customer is responsible for the loss, theft, damage or destruction of the rented product and agrees to pay the full replacement value of it.
The customer agrees to return the rental product in the same condition in which it was delivered and to report any loss, theft, damage or destruction of the rental item immediately to StrollerCare.
The customer is aware that he/she has been offered the opportunity to purchase insurance to cover theft, damage or destruction of the rented product and has chosen/refused to purchase the insurance.
Insurance and insurance exemption
Insurance covering theft, destruction or accidental damage is available for purchase prior to finalizing this contract and at any time before taking possession of the rental product. Insurance is not available for purchase after taking possession of the rental product.
It is the sole responsibility of the customer to determine their participation in the purchase of an insurance waiver. At no time will any guarantee be made by StrollerCare or understood by the customer that liability for the rented product has been dissolved from the customer without the purchase of insurance.
The insurance becomes null and void in the event of fraud by nature of misrepresentation. The insurance does not cover any rented items that are not returned to the appropriate location, nor any items left in the guests’ room. The insurance is only for items rented from StrollerCare and does not include any personal items of the guests. Insurance ends at the designated return time listed on the reservation. Items not returned by the designated time will no longer be covered by the insurance.
Insurance will be granted to the customer who books a StrollerCare product for which the insurance fee is paid for that item. This insurance shall at no time be transferable to any person other than the customer. The insurance is only valid and enforceable as long as it is held by the customer. The customer will forfeit any right to the benefit of the insurance purchased if they cede control or possession of the rental item(s) at any time to any individual who is not part of the original rental agreement.
The insurance purchased by the customer will be null and void in the following cases:
- The customer abandons the rented products during the rental contract period;
- The customer dismantles or removes parts of the rented products that are not intended to be removed as part of their normal operation;
- The customer uses the rented product for any purpose other than its intended purpose;
- The customer does not communicate changes to the agreed delivery or pick-up locations;
- The customer does not notify StrollerCare immediately after the discovery of a stolen item (within 2 hours of discovery);
- The customer does not send a lost/stolen product report to the theme park or resort where the loss occurred within 2 hours of discovery;
The insurance does NOT cover the following cases:
- The rented products are abandoned or forgotten in a theme park, shopping center or other facility;
- The rented products are abandoned or forgotten in a bus, car, cab or other means of transportation;
- Rented products left unsecured in a hotel, resort or vacation home;
Damage caused to the equipment by third parties; - Damage to or discoloration of the stroller fabric due to the application of sunscreen, suntan lotions or sprays;
- Marker or pen markings inside the stroller.
Please note: the insurance does not cover the replacement of a rented product due to vomit or leaking diapers. The insurance does not cover replacements of wet strollers caused by rain or other incidents beyond StrollerCare’s control. The customer receives free rain covers to protect the strollers. A replacement fee of US$10 will be charged for the replacement of a wet stroller and is subject to model availability.
If a rental product is stolen, the customer must obtain a report from theme park security and provide a copy of this report to StrollerCare. If the event takes place outside a theme park, the customer must file a police report with the local police department and provide a copy of the report to StrollerCare.
Any incident of theft must be reported to theme park security or the local police and to StrollerCare within 2 hours of the incident. This notification must be in the form of an e-mail. Any incident not reported in time will void the insurance purchased for the rented item.
The insurance does not guarantee the replacement of the product if it has been stolen or lost. To replace a stolen or lost item, a new rental reservation must be made.
Recovery system
All our strollers have a monitoring system installed. The system is deactivated if the customer does not choose to contract the service or does not use it during the rental period. The tag located on the stroller must not be removed by the customer and may result in a $20 fee if the tag is removed or lost. StrollerCare does not monitor the route taken by the product, unless requested by the customer in the event of loss or theft. In the event of loss or theft, the customer must notify StrollerCare immediately for the best chance of recovery.
The recovery system offers no guarantee that the product and/or your personal belongings will be recovered. In the event that the product and your personal belongings are not found, StrollerCare is not responsible for the value of the products and will not reimburse you. The insurance and the stroller and personal belongings recovery system are not the same thing. If the stroller is not found and the customer has not paid for the insurance, the value of the stroller will be charged according to the values on Amazon.
Cancellation
A full refund will be given for all cancellations made 48 hours or more before the rental date. All cancellations made within the 48-hour period will be charged 50% of the total amount of the order. Refunds are made via the Stripe platform.
Statement of responsibility
By accepting and using the rented product, the customer acknowledges that the item will be used at the customer’s own risk. StrollerCare hereby makes no warranties with respect to the rented equipment, and StrollerCare specifically disclaims all warranties, whether express or implied.
StrollerCare is not responsible for accidents, injuries or damage caused directly or indirectly by the use or misuse of the rented equipment.
The customer agrees to hold StrollerCare harmless from any liability, injury, death, loss of property or damage that may result directly or indirectly from the use of the rented product.
